REGULATIONS

Regulations define terms and conditions of Apartments rental services offered by Live and Travel Apartments via www.liveandtravelapartments.pl.

 

§ 1 GENERAL PROVISIONS

  1. This Terms and Conditions of Booking and Short Term Lease of Apartments (hereinafter called “Terms and Conditions”) constitute an integral part of the short term holiday lease agreement concluded between the Guest and Live and Travel Apartments.

  2. Live and Travel Apartments hereby declares that under the separate agreement with the owner of the Apartment it is authorized to manage the Apartment and to render lease services to the guest with regard to short term holiday stay. 

  3. By entering into the lease agreement with Live and Travel Apartments the Guest agrees that his personal data may be processed by Live and Travel Apartments to such an extent that is necessary for completion of booking as well as for marketing purposes, all in accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

 

§ 2 BOOKING AN APARTMENT

 

Before making a booking , Guest commits to familiar with Terms and Conditions of booking. By making a booking Guest hereby declares that he/her read and understood Terms and Conditions of booking and House rules.

 

  1. Booking of the Apartments can be made by the Guest either on line on www.liveandtravelapartments.pl or through e-mail or by phone. The Guest hereby represents that he/she is an adult and has full capacity to enter into a lease agreement.

  2. After booking the Apartment the Guest shall receive a booking confirmation via e-mail (at such e-mail address as it was provided by the Guest to Live and Travel Apartments during booking procedure) which shall include description of the Apartment, place and term of stay, as well as lease price, value of  the security deposit  and the terms of payment, (hereinafter called the “Booking Confirmation”).

  3. In case the Guest did not receive the Booking Confirmation by e-mail he/she would be obliged to contact the booking centre by phone within 24 hours. Through Booking Confirmation a lease agreement between the Guest and Live and Travel Apartments is concluded on such Terms and Conditions as set forth in the Booking Confirmation and this Terms and Conditions.

  4. The minimum period for booking an Apartment is 2 nights. Booking a shorter period is possible when the Customer extends his/her stay beyond the period indicated or stay finishes on the day when a new booking starts.

  5. Photos and descriptions that can be found on the webpage are for informational purposes only and they do not constitute an offer under Article 66 Section 1 of the Polish Civil Code.


    § 3 SERVICE FEE, SECURITY DEPOSIT AND TERMS OF PAYMENT

 

  1. Price for the short term holiday lease of the Apartment is included in the Booking Confirmation (§ 2 point 3 of this Terms and Conditions).

  2. All prices in the Booking Confirmation and on the webpage include 8% of value added tax.

  3. The price for the short term holiday lease service paid by the Guest includes:
       - booking fee
       - price for leasing the Apartment for number of people declared at the booking

  4. When booking the Apartment online on www.liveandtravelapartments.pl the Guest shall make payment of the booking fee, at the amount of 30% of the price for the short term holiday lease which is a non-refundable fee for a reservation and preparing of the Apartment for holiday stay of the Guest;  Payment of the booking fee shall be made directly on www.liveandtravelapartments.pl, by credit card, Paypal or PayU. When booking the Apartment through email or by phone, the Guest shall make a payment of the booking fee (30% of the price for the short term holiday lease -§ 3 point 3a above) to Live and Travel Apartments bank account indicated in the Booking  within 3 days (72 hours) from receiving the Booking Confirmation. The  remaining 70%  of the price for the short term holiday lease ( § 2 point 3b of this Terms and Conditions) and security deposit shall be paid by the Guest to Live and Travel Apartments bank account, indicated in the Booking Confirmation, not later than 21 days before commencement of lease.

  5. When booking the Apartments 30 days before scheduled check in date full amount must be paid

  6. Booking fee is non-refundable fee for a reservation and preparing of the Apartment for holiday stay of the Guest and  parking space (if aplicable) and it is not the price for stay in the apartment.

  7. Price for leasing the Apartment, at the amount of 70% of the price for the short term holiday lease, which includes cleaning of the Apartment and washing towels and bed linen after the Guest’s stay.The price for the short term holiday lease service does not cover additional cleaning, changing towels and bed linen during Guest’s stay, renting of an infant’s crib, animal’s stay and a parking fee.

  8. Live & Travel Apartments requires the security deposit to be paid by Guest in order to secure future claims. The security deposit shall be in the amount of 500 – 1000 pln dependable on the Apartment’s standard.

  9. This security deposit is returned to the Guest by Live and Travel Apartments at the time of Guest’s check out and returning of the keys to the Apartment. Security deposit will be returned to the Guest in the way and method it was paid to  Live and Travel Apartments. In case the Resident acknowledges any damage or losses in equipment made by the Guest(or people staying with him/her) to the Apartment’s equipment or the Apartment itself, the amount from the security deposit shall be deducted. The deducted amount shall be an equivalent of costs incurred for repairs or losses in equipment. The Customer bears also financial responsibility for the damage when costs of repairs or replacement of any breakages, losses or damage to the property or contents exceed the security deposit.
     

§ 4 BOOKING CHANGES / CANCELLATION  BY GUEST

 

  1. Changes of booking dates are only allowed  14 days before scheduled check in date and only if the Apartment is available for lease on the new dates. Guest is obligated to pay any price difference resulting from changing booking dates.

  2. In the event when changes of booking dates are not possible and the Guest cancels booking, terminates the lease agreement or does not check-in on a check-in date, the booking fee, as defined in § 3 point 3a of this Terms and Conditions, shall not be refunded. 

  3. When the Guest terminates the lease agreement on grounds other than Live & Travel Apartments fault, the booking fee shall not be refunded.

  4. Cancellation or shortening stay less than 14 days prior to scheduled arrival obligates the Guest to pay the total due amount for resigned nights

  5. The cancellation conditions for reservations may vary depending on the chosen offer

  6. Cancellation of non - refundable offer will not be refunded.

 

§ 5 BOOKING CHANGES / CANCELLATION  BY LIVE AND TRAVEL APARTMENTS

  1. Live & Travel Apartments may only make changes in booking of the Apartment in the event of force majeure that prevents Live & Travel Apartments from complying with its obligations under the lease agreement concluded with the Guest. Event of force majeure means any event beyond Live & Travel Apartments control, including but not limited to natural disasters, occupation of the Apartment by any state, governmental or public authority for any reason, strikes, wars, riots and the Apartment deprivation of electricity, gas, heating or water supply by suppliers of these media without fault of Live & Travel Apartments. In the event of force majeure that makes the Apartment unavailable for the Guest, Live & Travel Apartments shall offer the Guest another Apartment or change booking for another period of time or terminate the lease agreement and refund the booking fee.

  2. Only in exceptional situations(such as break down or malfunctions or failure in the Apartment) may Live & Travel Apartments offer a substitute apartment to the Guest. The substitute apartment shall be of the similar size and standard and in the same city as the Apartment booked by the Guest. If the Guest does not accept the substitute apartment, the lease agreement terminates and Live & Travel Apartments shall refund the booking fee and other fees or deposits, if any, paid by the Guest.

  3. In the event of changes or cancelation of booking by Live & Travel Apartments, for reasons other than those described in points 1 and 2 above, Live & Travel Apartments shall refund the booking fee and other fees or deposits, if any, paid by the Guest and pay a penalty to the Guest at the amount equal to the amount of booking fee for the Apartment.

  4. Live and Travel Apartments does not return any funds for unused stay.

 


§ 6 GUEST STAY AND HOUSE RULES

 

  1. Check-in time is at 15.00 hours on the first day of Guest’s stay. The Guest shall check-in at the time agreed with Live and Travel Apartments. The Guest shall examine the cleanliness and the technical condition of the Apartment right after entering the Apartment. The Guest shall inform Live and Travel Apartments at least 24 hours before scheduled check-in time if scheduled check-in time falls outside of the working hours of Live and Travel Apartments local office.

  2. During check-in the Guest and other people staying in apartment are required to present a valid photo documentation (ID, passport) and pay in cash the due amount.

  3. The keys shall be handed-over after settling above mentioned formalities.

  4. The resident has the right to refuse handing-over keys when the Customer:
      - does not possess a valid ID or or does not want to present it
      - is under the influence of alcohol or other substances,
      - behaves in an aggressive manner.

  5. The Guest is required to obey curfew, safety rules and fire safety regulations in the Apartment and in the building. Between 22.00 hours and 06.00 hours any behaviour causing disturbance to residents of the neighbouring apartments is prohibited. In the case of a received complaint, a Company’s Representative has the right to terminate an agreement with immediate effect without refund previously filed charges for remained stay. A fine of 300 PLN may be imposed by Live and Travel Apartments in case of police intervention due to Guest’s fault.

  6. The Apartment shall be occupied by the Guest solely for the purpose of short holiday stay. The Guest shall not remove any piece of equipment, furniture or decoration from the Apartment. The Guest shall not make duplicates of the keys to the Apartment.

  7. Smoking in the Apartment is prohibited. The Guest who does not observe the non-smoking rule shall be charged 500 PLN to cover the cost of dry cleaning of curtains and bed covers in the Apartment.

  8. When leaving the Apartment the Guest is required to shut all windows, to lock the door and safeguard the keys.
    The Guest must ensure that an Apartment is properly secured and keys are being kept without access of the third party. In case of losing or not returning keys, a penalty of 400 PLN shall be imposed.

  9. The Guest is responsible to ensure that the number of persons staying in the Apartment does not exceed the maximum number of gests indicated in the Booking Confirmation, in the catalogue or on relevant webpage. The number of guests staying in the apartment is limited to the one stated in the contract. If the number of Guests staying in the apartment turns out to be bigger than the one given durin the reservation process, the Guest is obliged to pay the additional charge of 150 PLN/per day/per person. In case of exceeding the maximum number of persons staying in the apartment, Live and Travel Apartments holds the right to deny the key handoff.

  10.  Animals are not allowed in the Apartment unless it is agreed with Live and Travel Apartments.

  11. The Live and Travel Apartments leaflet placed in the Apartment will contain the telephone number, to be used by the Guest to make requests or complaints related to the Apartment.

  12. The Guest is responsible for any damage to the Apartment, its furniture, decoration and equipment, as well as for any damage to neighbouring apartments and premises, reasonable use and wear and tear excepted, caused by the Guest or other persons who stay in the Apartment during term of lease.

  13. The Guest is liable to cover all damage described in point 12 above. The Guest shall inform The Live and Travel Apartments about any and all destruction or damage caused by the Guest or other persons who stay in the Apartment during the term of lease

  14. To cover damage described in points 12 and 13 above, Live and Travel Apartments may deduct charges from the security deposit and/or debit the Guest’s credit card. All costs of repair will be calculated based on local market prices. If damages exceed the amount of deposit Live and Travel Apartments may claim the excess from the Guest and the Guest shall pay all amounts due within 5 days from Live and Travel Apartments written demand.

  15. In case an exceptionally blatant or hooligan behaviour, Live and Travel Apartments has the right to terminate an agreement with immediate effect without refund previously filed charges for remained stay and  remove Guest with other people staying in apartment from the property.

  16. Check-out time is at 10.30 hours on the last day of the Guest’s booked stay or other  time agreed with Live and Travel Apartments, the Guest shall return the keys, gate remote to the Apartment to Live and Travel Apartments. The Guest shall assist Live and Travel Apartments during inspection of the Apartment conducted by Live and Travel Apartments before check-out. The Guest shall return all keys and remotes to Live and Travel Apartments before leaving the Apartment.

  17. Early departure of the Guest of circumstances for which Live and Travel Apartments is not responsible, does not entitle the Guest to refund of the unused time.

§ 7 CLAIMS

 

  1. The Guest’s claims mean all suggestions, requests and complaints regarding: 

  1. Conditions of stay that do not comply with standards described in Live and Travel Apartments offer published on its webpage www.liveandtravel.pl

  2. Customer services standards

  3. Circumstances under Live and Travel Apartments control materially affecting standard of stay in the Apartment.

  1. The Guest’s claims shall be submitted to Live and Travel Apartments in writing or in an equivalent electronic form.

  2. Personal data, including current address, e-mail address and a phone number of a person submitting claim as well as a booking number shall be communicated to Live and Travel Apartments together with claim.

  3. The Guest’s claim shall contain: - the number and identification of Apartment in question; - detailed description of circumstances under claim; and - accurate description of request or demand.

  4. The Guest’s claims that meet the required form and content shall be answered by Live and Travel Apartments within 14 working days from their receipt.

 

§ 8 FINAL PROVISIONS

 

  1. Live and Travel Apartments is not responsible for any interruption of access to booking system on its webpage www.liveandtraveapartmentsl.pl for reasons out of Live and Travel Apartments control.

  2. Live and Travel Apartments may from time to time undertake upgrade and maintenance of its webpage www.liveandtravelapartments.pl

  3. Neither Live and Travel Apartments nor the owner of the Apartment shall be liable for any loss or damage to the Guest’s property that may occur in the Apartment or within premises which the Apartment is a part of or for any damage to or loss of goods left in the Apartment

  4. Neither Live and Travel Apartments nor the owner of the Apartment is responsible for any inconvenience that may occur during the Guest’s stay in the Apartment for reasons other than Live and Travel Apartments or the owner’s fault, included but not limited to: interruptions in power, gas or water supply as well as the operation of elevators, renovations or restoration works conducted within the premises of which the Apartment is a part of or their surroundings and vicinity.

  5. Making a reservation is equivalent to accepting these Terms and Conditions.

  6. The rental agreement is effective upon paying a Security Deposit.

  7. The law applicable to disputes between than Live and Travel Apartments and the Customer is the Polish law. Disputes shall be settled by the court competent for the seat than Live and Travel Apartments.

 

§ 9 ADDITIONAL CHARGES AND SERVICES

 

  1. Final cleaning service of the Apartment costs 100 PLN

  2. Rental of a baby bath tub is 30 PLN / piece – one off cost.

  3. Rental of a baby’s bed is 30 PLN / piece – one off cost

  4. Rental of a baby’s highchair is 30 PLN / piece – one off cost.

  5. Rental of an additional bed for an adult person – 80 PLN - one off cost.

  6. Upon request, Live and Travel Apartments offers a transport service from the airport to the Apartment. The cost of the service:

  • up to 4 PERSONS 100 PLN

  • up to 8 PERSONS 200 PLN

§ 10 PRIVACY POLICY

 

 

Information on the processing of your personal data

 

We hereby inform you that we process your personal data. Details of this can be found below. Whenever we use the abbreviation RODO below, we mean Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on data protection) (OJ L 119, p. 1)

I. Personal data administrator

 

We, Live & Travel Apartments PL Sebastian Baranowski with headquarters at Kolorowa 6/20, 80-180 Gdańsk are the Administrator of your personal data.

II. Purposes and basics of processing

 

  • In order to inform you about our offer, based on your consent (the basis of art.6 par.1 lit.a RODO);

  • In order to conclude a lease agreement based on your interest in our offer (the basis of art.6 par.1 lit.b RODO);

  • In order to perform and on the basis of a contract concluded with us (basis from Article 6 paragraph 1 letter b of the GDPR);

  • In order to meet tax obligations and other administrative obligations, on the basis of obligations arising in particular from the following acts: on personal income tax, on value added tax, corporate income tax, on local taxes and fees (based on art.6 par.1 lit.c RODO);

  • For analytical purposes regarding: guest preferences, technical logs of our website, optimization of procedures for concluding and performing contracts, handling complaints and notifications about failures, which is our legitimate interest (basis from Article 6 paragraph 1 letter f of the GDPR);

  • For archival (evidentiary) purposes to secure information in the event of a legal need to prove facts, which is our legitimate interest (basis from Article 6 paragraph 1 letter f of the GDPR);

  • In order to possibly determine, investigate or defend against claims, which is our legitimate interest (the basis of Article 6 para. 1 lit.f RODO);

  • In order to examine guest satisfaction and determine the quality of our service, which is our legitimate interest (basis from Article 6 paragraph 1 point f of the GDPR).

III. Categories of your personal data that we process

 

We process the following categories of your personal data: name and surname, address of residence, PESEL, ID number or other identity document number, email address, telephone number.

 

IV. Data recipients

We can share your personal data with our subcontractors, i.e. entities that we use for processing: accounting, law and IT companies, as well as other independent recipients: banks, property management companies, cleaning companies, servicing the technical equipment of buildings and premises, dealing with the delivery of correspondence.

 

 

 

 

V. Transfer of data to third countries or international organizations

 

We do not transfer your data outside of Poland / EU / European Economic Area

VI. Data storage period

 

We store the data provided to us to inform you about our offer until you object, and the longest to the end of the year following the year in which you provided it. If you have agreed to direct marketing, we will process your data until you object. We process the data obtained in connection with the conclusion of the lease agreement until the end of the limitation period for potential claims under the agreement.

VII. Your rights You are entitled to:

 

  1. the right to access your data and receive a copy thereof;

  2. the right to rectify (correct) your data;

  3. the right to delete data - if you think there are no grounds for us to process your data, you can request that we delete it;

  4. the right to limit data processing - you can request that we limit the processing of your personal data only to their storage or performance of activities agreed with you, if in your opinion we have incorrect data about you or we process it unreasonably; or you do not want us to remove them because you need them to determine, pursue or defend claims; or for the time you object to data processing;

  5. the right to object to data processing:

  1. "marketing objection" - you have the right to object to the processing of your data in relation to conducting direct marketing. If you exercise this right - we will stop processing data for this purpose.

  2. objection due to a special situation - you also have the right to object to the processing of your data on the basis of a legitimate interest for purposes other than direct marketing. You should then show us your particular situation, which in your opinion justifies our cessation of processing the objectionable data. We will stop processing your data for these purposes, unless we indicate that the grounds for processing your data override your rights or that your data is necessary for us to determine, assert or defend claims.

  1. right to data portability: you have the right to receive from us in a structured, commonly used, readable format personal data about you that you have provided to us under a contract or your consent. You can also send this data directly to another entity;

  2. the right to lodge a complaint with a supervisory body - if you think that we are processing your data in accordance with the law, you can file a complaint to the President of the Office for Personal Data Protection or another competent supervisory body;

  3. the right to withdraw consent to the processing of personal data - you have the right to withdraw consent to the processing of personal data that we process based on your consent at any time. Withdrawal of consent will not affect the lawfulness of the processing based on your consent before its withdrawal.

VIII. Information on the requirement / voluntary provision of data

 

Providing your data is the condition for concluding the contract and is voluntary.

However If you do not provide data, we can refuse to conclude a contract or to issue an apartment even if we have previously concluded a contract.

 

 

IX. Information on the data source

 

We have obtained your personal data directly from you or from entrepreneurs operating booking portals, e.g. Booking.com, Airbnb.com.
